Procedures for recording an instrument

Before recording an instrument, please check the following:

  1. Date
  2. Grantee's mailing address (if Deed)
  3. Description of property
  4. Two witnesses (if Deed)
  5. The signed and typed names in agreement
  6. Acknowledgment
  7. Notary public seal and expiration date and whether personally known or produced identification
  8. Corporate seal, if applicable

The statement below must appear on the face of all instruments by which the title to real estate or any interest in it or lien on it is conveyed, created, encumbered, assigned, or otherwise disposed of prior to being recorded by the Clerk of the Circuit Court.  (Florida Statutes, Chapter 695.24).

Due to the repeal of Section 201.022, F.S., Form DR-219 (Return for Transfers of Interest in Real Property) is no longer required when recording a document transferring title to property, effective June 1, 2008.  The Clerk's Office previously obtained the transfer price from Form DR-219.  Therefore, it is requested that all customers submitting documents for recording include a Recording Transmittal Form to expedite the processing of documents.

Also, there are drop boxes for recording documents available in the following locations:

  1. At the Lake County Public Records Center, 122 East Main Street, Tavares on the South side of the building. The entrance to access the drop box is located near the rear parking lot on Ruby Street.  Document pick up times are 9:30 a.m. and 3:15 p.m. each business day.
  2. At Center State Bank, 1211 W. North Blvd., Leesburg on the U.S. Highway 441 side of the building. Pick up time is 10:30 a.m. each business day.

When utilizing the drop boxes, please keep in mind that only non time-sensitive documents should be deposited, no cash payments should be enclosed, and the Clerk assumes no liability for items placed in the boxes.

Checks should be made payable to: NEIL KELLY, CLERK OF THE CIRCUIT COURT.

Documents will be returned via U.S. Postal Service First Class Mail. Self addressed, stamped envelopes are not required but may be included to expedite service. In order to have documents returned in any other manner, please include a return envelope along with the appropriate form of payment such as an overnight shipping account number.

Documents are generally returned within 4-5 business days after receipt in our office.  However, this turnaround time is subject to change based on the volume of documents.
